Colorado State law House Bills 23-1099 and 25-1236 pertain to residential tenant screening, specifically Portable Tenant Screening Reports (PTSR). The Portable Tenant Screening Reports (PTSR) combine credit history, rental history, a criminal background check, income and employment verification, and eviction history. The PTSR initially had to be provided to a landlord by a third party but in 2025, Colorado legislators amended the House Bill to allow for tenants to provide their own PTSR to landlords, negating the need to have it housed and then provided to a landlord through a third party.
This amendment provides for a smoother and quicker process of getting this vital information from a tenant to the landlord, allowing the landlord to quickly and efficiently review the prospective tenant’s information and decide their suitability as a tenant.
Colorado State Law – Portable Tenant Screening Report (PTSR) (Also known as a Reusable Tenant Screening Report (RTSR))
The state law mandates landlords are required to accept a full and accurate PTSR and not charge the tenant for an additional report upon their acceptance of the PTSR. A landlord that violates the provisions of the act is liable for $2,500, plus court costs and attorney fees, but if the landlord cures the violation within 7 calendar days after receiving notice of the violation, the landlord is to pay the prospective tenant a penalty of $50 and is otherwise not liable for damages. Lastly, the amended bill provided a provision to not include a credit history depending if the prospective tenant is applying for a housing subsidy or not. (Due to this final provision, we offer two (2) forms of our report depending on if you are applying using a housing subsidy or not.)
